  • This privacy statement is made on behalf of SmartCharts Pty Limited, Australia.
  • We may process your data according to the jurisdiction in which the processing is undertaken. SmartCharts will ensure your rights are upheld in accordance with the GDPR and the Data Protection Act 2018. We may also process your personal data in accordance with Australian data protection law.
  • This privacy notice applies to the use of personal information by SmartCharts Pty Ltd 
2. WHO WE ARE

SmartCharts is a software provider that has a proprietary [analytical system] called SmartCharts. We are committed to respecting your privacy and keeping your information safe. We want to give you clear information about what information we collect and how we use it. We are committed to respecting your privacy and keeping your personal information. This privacy and cookies policy tells you what to expect when Smart Charts collects personal information. This privacy and cookies policy relates to our use of personal information we collect from you via the following: - 
• SmartCharts Website and Landing Pages
• Social Media
• 3rd party marketing referrals
• When you work for Smart Charts
• Any other purpose for which we may process your data in connection with our products and services


3. WHAT PERSONAL INFORMATION WE COLLECT ABOUT YOU

We collect personal information about you. We may collect this information when you:
• Subscribe to SmartCharts 
• Sign up for publications or newsletters 
• Telephone, write, contact us online or text us or otherwise provide us with your personal information. This can include information such as your name, email address, postal address, IP address, telephone number and mobile number.  
• When one of our group organisations shares your data with us
We only collect sensitive personal if we are under a legal obligation to do so, for example, relating to your health if you request special assistance for an event. Any such information is securely stored on your delegate profile.

4. HOW WE USE YOUR INFORMATION

We will not rent, swap or sell your personal information to other organisations for them to use in their own marketing activities without your consent.
We may share your data where we have a contractual obligation or legal obligation to do so.
The legal basis that we rely on for processing your data will depend upon the circumstances in which it is being collected and used, but will in most cases fall into one of the following categories:
• Where you have taken clear affirmative action and consent may be implied. For example where you have provided your personal data via an online form.

• Where it is in our legitimate interests to perform our functions; for example, we may share your data in certain circumstances with Learn to Trade Ltd, Capital Index (UK) Ltd and Capital Index (Cyprus) Ltd 
It is in our interest to ensure our delegates have the best possible service and experience and therefore we deem it in our legitimate interests to share this information. Wherever we may process your data in our interests you may object to such processing activities.
If you have given your consent, we may use your information for a number of purposes including the following:
• To collect personal information about you, your interests and your likes
• Share your information with Learn To Trade Ltd. Capital Index (UK) Ltd, and Capital Index (Cyprus) Ltd 
• Send you information regarding the specific forex trading workshop you have booked
• Send information on other products and services of the Learn to Trade Group 

5. DO WE SHARE YOUR DATA WITH 3RD PARTIES?

If you are a customer/ subscriber of Smart Charts your data may be shared with Learn to Trade (“LTT”) because LTT facilitates educational programmes included in some products purchased from SmartCharts .
Your data is shared with Capital Index (UK) Limited and Capital Index (Cyprus) Ltd when you subscribe to Smart Charts because a demo trading account is created which is supported by Capital Index.
We may also share your data where we have a legitimate interest to do so and where we have a contractual or legal obligation
Each entity that collects or receives your data under the privacy notice does so as a data controller. Any member may use, the information you provide and other information it holds about you for the purposes set out in the privacy notice, applying appropriate security measures to keep your information safe and secure.
Learn To Trade and Capital Index may have specific privacy notices on their websites so when visiting or using these services please make sure you are informed of how they also use your information.

6. INTERNATIONAL TRANSFERS

We may share your data outside of the EU and the UK where we have established it may be lawful to do so. In such circumstances, we may undertake assessments of risk to your fundamental rights and freedoms in accordance with the GDPR. Safeguards may be required including the use of the EU Standard Contractual Clauses (SCCs) or where appropriate, the UK International Data Transfer Agreement (IDTA) Your contact details are shared with EMPOWER U Inc a company registered in the Philippines and the US, the safeguards referred to above apply in these jurisdictions. Where we share your data with other group companies, they may store your data in different jurisdiction. Please consult the relevant privacy information for further details. The data is shared by way of a customer relationship marketing system and therefore no export or external transfer takes place. Your data is securely stored on this system.

7. OTHER WAYS WE USE YOUR INFORMATION

We may carry out analysis of the information we collect about you to optimise the products and services we provide.
We also use your data to find similar profiles of person using marketing tools within Facebook and Google. 

8. WILL I BE CONTACTED FOR MARKETING PURPOSES

SmartCharts, Learn to Trade and Capital Index will only send you marketing emails where you have consented to this and you are able to withdraw your consent and stop such communications at any time by updating your preferences. 
We may use information which we hold about you to show you relevant advertising on third party sites. 

9. HOW LONG WILL SMARTCHARTS KEEP MY INFORMATION?

We will hold your personal information on our systems for as long as is necessary or where the law permits for the relevant activity or until you request that we remove your information from our systems via our Telling Us When Things Change section.

10. TELLING US WHEN THINGS CHANGE

You can help us keep our records up to date by telling us when your contact details and other personal information changes. You can also change your mind at any time about how we contact you or ask us to stop contacting you altogether.

11. CAN I FIND OUT WHAT PERSONAL INFORMATION SMARTCHARTS HOLDS ABOUT ME

You have the right to request access to the personal information we hold about you and to have any inaccuracies corrected. There is no fee for the first request. A fee may be charged where the request is excessive or for subsequent requests. We require you to prove your identity with 2 pieces of approved identification. We will provide you with the information within 1 month of your request unless requests are complex, in such circumstances we may extend the period to a maximum of three months

12. COOKIES – PRIVACY POLICY

3) WHY DOES SMARTCHARTS USE THESE TECHNOLOGIES?
